Agreement to Sell

AGREEMENT TO SELL THIS AGREEMENT is made on this [date] at [place] between: 1. [vendorName], resident of [vendorAddress], hereinafter called the Vendor. 2. [vendeeName], resident of [vendeeAddress], hereinafter called the Vendee. WHEREAS the Vendor is the owner of the property situated at [propertyAddress] and has agreed to sell the same to the Vendee for Rs. [salePrice]. NOW THIS AGREEMENT WITNESSETH AS UNDER: 1. That the total sale price is Rs. [salePrice]. 2. That the Vendee has paid Rs. [advanceAmount] as advance/bayana to the Vendor. 3. That the balance amount of Rs. [balance] shall be paid by the Vendee at the time of registration of the Sale Deed. 4. That the Sale Deed shall be registered on or before [date]. 5. That the Vendor shall hand over the possession of the property at the time of registration. 6. That if the Vendor fails to execute the Sale Deed, the Vendee shall be entitled to specific performance.
